# State Mail Disclosure and Solicitation Laws

### Why this matters

Some states require specific on-mail disclosures so your piece is clearly a solicitation. Missing these can cause complaints, fines, or campaign delays. Place disclosures where recipients see them first. Keep them obvious and easy to read.

### States with notable requirements

<h3 align="center">Georgia, real estate sale solicitations</h3>

**When it applies:** You mail Georgia property owners to ask if they want to sell.\
**Include all that apply:**

* **On the mail piece, at the top, in all caps:**\
  “THIS IS A SOLICITATION. THE SENDER IS CONTACTING YOU TO INQUIRE AS TO YOUR INTEREST IN SELLING YOUR HOME OR OTHER REAL ESTATE. YOU ARE UNDER NO OBLIGATION TO RESPOND.”
* **If you show a price, immediately below the price:**\
  “THIS OFFER MAY OR MAY NOT BE THE FAIR MARKET VALUE OF THE PROPERTY.”
* **If that price is below the prior year county assessed value, next line:**\
  “THIS OFFER IS LESS THAN THE COUNTY ASSESSED VALUE FOR THIS PROPERTY.”
* **Outside of the envelope or postage panel:**\
  A clear and conspicuous “SOLICITATION” notice.

**Formatting notes:** Use clear contrast. Size should be at least as large as other text and never minimized. Keep spacing so each notice stands out.

<h3 align="center">Illinois, anti-deceptive postcard and letter rules</h3>

**When it applies:** You ask recipients to contact you and you may offer goods or services later.\
**Include at the very top, inside a black-outlined box, at least 14-pt bold:**

* A statement that the piece is a solicitation and not a bill or invoice.
* A statement of affiliations or that you are not affiliated with any brand, dealer, manufacturer, or organization referenced.

**Example box text you can use:**\
“THIS IS A SOLICITATION, NOT A BILL OR INVOICE. IF YOU CONTACT US, GOODS OR SERVICES MAY BE OFFERED FOR SALE. WE ARE NOT AFFILIATED WITH ANY GOVERNMENT AGENCY OR ANY MANUFACTURER OR DEALER REFERENCED IN THIS MAILING.”

<h3 align="center">California, consumer-finance solicitations</h3>

**When it applies:** You mail California consumers about a consumer financial product or service.\
**Include both:**

* **On the envelope front:** Disclosure in at least 16-pt bold.
* **Inside the solicitation:** Disclosure in at least 18-pt bold.

**Required statement:**\
“THIS IS AN ADVERTISEMENT. YOU ARE NOT REQUIRED TO MAKE ANY PAYMENT OR TAKE ANY OTHER ACTION IN RESPONSE TO THIS OFFER.”

<h3 align="center">Florida, government-impostor and deceptive advertisements</h3>

**When it applies:** Your mail could look like it is from or approved by a government entity, or you offer documents available for free or cheaper from a government office.<br>

**Required placement:** Outside front of the envelope and at the top of each printed page.<br>

**Sample notice for document-offer ads:**\
“IMPORTANT NOTICE: The documents offered by this advertisement are available to Florida consumers free of charge or for a lesser price from \[insert government entity name, phone, and mailing address]. You are not required to purchase anything from this company and the company is not affiliated, endorsed, or approved by any governmental entity. The item offered in this advertisement has not been approved or endorsed by any governmental agency, and this offer is not being made by an agency of the government.”

### Quick setup checklist

* Pick the state. Copy the exact wording above.
* Check placement. Top of piece, envelope front, or both as required.
* Check size and readability. Illinois 14-pt bold in a box. California 18-pt inside and 16-pt on envelope. Keep Georgia and Florida conspicuous and easy to see.
* Save proofs of final art, envelope panels, and mailing dates.
